Terms of Sale

Please read these terms carefully before ordering. They apply to every order placed through medicare.haus, by trade account, subscription or otherwise. We sell to businesses and qualified professionals only.

1. About us

medicare.haus is operated by [Company legal name] Ltd, trading as Medicare.Haus, a company registered in England and Wales under number [Company number], with its registered office at [Registered office address], United Kingdom. VAT number: [VAT number].

Contact: hello@medicare.haus. References to "we", "us" and "our" mean [Company legal name] Ltd.

2. Definitions

  • Buyer / you — the business, clinic or practitioner placing an order.
  • Contract — the contract for the sale of Goods formed under clause 5.
  • Goods — the products described in an order.
  • Delivery Confirmation — the carrier's electronic record that the parcel was delivered, left in a nominated safe place, or signed for.
  • Trade Account — an account approved by us under the Trade Terms.
  • Working Day — any day other than a Saturday, Sunday or bank holiday in England.

3. Business-to-business supply only

We supply Goods only to buyers acting in the course of a trade, business or profession. By ordering, you confirm that you are not buying as a consumer and that the Goods are for professional use or authorised resale.

Because you are buying as a business, the consumer rights in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, including the 14-day cancellation right, do not apply. Nor does Part 1 of the Consumer Rights Act 2015. If we find that an order was placed by a consumer, we may cancel it and refund the price.

4. Professional eligibility and your obligations

You warrant that you, and anyone who uses the Goods:

  • are appropriately trained, qualified and, where required, registered with a relevant body (for example the GMC, NMC, GDC, GPhC or HCPC, or a recognised aesthetics register);
  • hold valid professional indemnity and public liability insurance covering the treatments performed;
  • will use the Goods only within your scope of practice, under any required prescriber oversight, and in line with the manufacturer's instructions for use, the product licence or CE/UKCA marking, and all applicable law, including the Health and Care Act 2022 licensing scheme when it takes effect;
  • will carry out appropriate consultation, consent and aftercare for every patient.

We may ask for evidence of any of the above at any time. We may refuse, suspend or cancel any order without liability if you do not provide it, or if we reasonably doubt that a supply would be lawful or safe.

5. Orders and acceptance

Each order is an offer to buy. The Contract is formed only when we send a dispatch confirmation. An order acknowledgement email is not acceptance.

We may decline any order, in whole or in part, including where stock is unavailable, a price or description error has been made, or eligibility is unconfirmed. If we decline after you have paid, we refund the amount paid for the declined Goods. That refund is our only liability.

You are responsible for making sure your order is accurate, including the products, quantities and delivery address.

6. Prices, VAT and trade pricing

Prices are in pounds sterling. VAT is added or included as shown at checkout. Delivery charges are shown before payment.

Trade prices and discounts are set per account and may vary by product line or product. LUXIA trade pricing is capped at 15% off list price, and LUXIA subscription pricing at 20%. Trade pricing is confidential to your account and may be changed or withdrawn at any time, but never after we have accepted an order.

If a price is obviously wrong, we are not bound by it, even after acceptance, and we will offer you the correct price or a refund.

7. Payment

Payment is taken in full when you order, through our secure checkout providers (Shopify Payments and Stripe). We never see or store your full card details. Credit terms apply only where agreed with us in writing.

Late payments on agreed credit terms carry interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998. We may suspend deliveries until payment is made.

8. Delivery

We deliver to UK addresses using tracked services. Delivery dates are estimates only, and time of delivery is not of the essence. We are not liable for delays caused by carriers or by events outside our control.

When your order is dispatched we email you tracking details. It is your responsibility to monitor tracking, to make sure someone is available to receive the parcel, and to arrange collection of any parcel held by the carrier. Temperature-sensitive Goods must be unpacked and stored correctly as soon as they are received.

Delivery is complete on Delivery Confirmation. That includes delivery to the address you gave us, to a neighbour or safe place you nominated, or to anyone at the address who signs for it.

9. Risk and title

Risk of loss, theft, damage or deterioration passes to you on Delivery Confirmation. After that point we are not responsible for parcels that are lost, stolen, left unattended, mis-stored or not collected.

Title to the Goods passes to you only when we have received payment in full.

10. No returns, no refunds

The Goods are professional medical, aesthetic and cosmetic products that must be stored and handled under controlled conditions. To protect patient safety and product integrity, we do not accept returns or give refunds or exchanges once Goods have been dispatched. That includes change of mind, ordering in error, over-ordering, or no longer needing the Goods.

The only exceptions are set out in clause 11. Please check your order carefully before you pay.

11. Damaged, faulty or incorrect Goods

If Goods arrive damaged, are faulty, or are not what you ordered, you must:

  • notify us at hello@medicare.haus within 48 hours of Delivery Confirmation;
  • include your order number, clear photos of the Goods, packaging and shipping label, and the batch/lot numbers;
  • keep the Goods unopened, stored correctly, and available for inspection or collection.

If your claim is valid, we will, at our option, replace the Goods or credit or refund the price paid for the affected Goods. This is your only remedy. Claims made after 48 hours, or for Goods that have been opened, used, mis-stored or tampered with, are not accepted, except for a latent defect that could not reasonably have been found on inspection, which must be reported within 7 days of discovery.

Non-delivery must be reported within 5 Working Days of the estimated delivery date. We cannot accept a non-delivery claim where the carrier holds a Delivery Confirmation.

12. Product information and no medical advice

Product descriptions, guides and Journal articles are for general professional information only and are not medical advice. Always follow the manufacturer's instructions for use, which take precedence over anything on our site. We do not make clinical claims on behalf of manufacturers.

Images are illustrative only, and packaging may change.

13. Warranty

We warrant that the Goods, on delivery, are genuine products obtained through authorised supply channels and are within their stated shelf life. To the fullest extent permitted by law, all other warranties, conditions and terms implied by statute or common law, including those under sections 13 to 15 of the Sale of Goods Act 1979, are excluded.

14. Limitation of liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for breach of the terms implied by section 12 of the Sale of Goods Act 1979, or for any other liability that cannot lawfully be limited.

Subject to that, we are not liable, whether in contract, tort (including negligence) or otherwise, for: loss of profit, revenue, business, goodwill or anticipated savings; any claim from your patients or clients arising from treatment you perform; or any indirect or consequential loss.

Our total liability for any Contract is limited to the price paid for the Goods under that Contract.

15. Indemnity

You indemnify us against all losses, claims, costs and expenses, including reasonable legal fees, arising from your use, storage, administration or resale of the Goods, any treatment you perform, or any breach of clause 4.

16. Recalls and safety notices

If a manufacturer or the MHRA issues a recall or field safety notice, we will tell you using your account details. You must follow it promptly, keep batch records that allow traceability, and report adverse incidents to the manufacturer and through the MHRA Yellow Card scheme.

17. Subscriptions

Subscriptions repeat an agreed order every 4, 6, 8 or 12 weeks, charged through Stripe before each dispatch. Each delivery is a separate Contract under these terms, including clauses 10 and 11.

You may pause or cancel by emailing us at least 3 Working Days before the next charge date. Charges already taken for dispatched orders are not refundable. We may change subscription prices with 14 days' notice. LUXIA subscription discounts never exceed 20%.

18. Suspension and account closure

We may suspend or close any account, or cancel undelivered orders, if you breach these terms, your registration or insurance lapses, payment fails, or we reasonably suspect misuse, unlawful resale or fraud.

19. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including carrier disruption, supplier shortages, pandemic, industrial action, extreme weather, cyber incidents or government action.

20. Intellectual property

All content on medicare.haus, including text, design, logos and the Medicare.Haus name, belongs to us or our licensors. Brand names and trade marks belong to their owners. You may not copy or reuse them without permission.

21. Personal data

We process personal data in line with our Privacy Policy.

22. General

  • Entire agreement: these terms, the Trade Terms and any written agreement with us form the entire agreement. Your own terms do not apply.
  • Changes: we may update these terms. The version in force when you order applies to that order.
  • Assignment: you may not transfer your rights without our written consent.
  • Severance: if any provision is invalid, the rest remain in force.
  • Waiver: a delay in enforcing a right is not a waiver.
  • Third parties: no one else has rights under the Contracts (Rights of Third Parties) Act 1999.
  • Notices: notices must be sent by email to the addresses on file.

23. Complaints, governing law and disputes

Please raise any complaint first with hello@medicare.haus. We aim to respond within 5 Working Days.

These terms and any dispute, including non-contractual claims, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
